Terms & Conditions

The rules that apply when you book a boat tour or transfer with SeaExplore. Written to be read — if anything here is unclear, ask us before you book.

1.Who you are contracting with

These terms govern boat tours and taxi-boat transfers sold on sea-explore.com. The service is operated by BILI, a company registered in Croatia, OIB 57502897113, based in Trogir, Croatia, trading as SeaExplore.

2.What we sell

We operate small speedboats carrying a maximum of 12 guests, with a licensed skipper and a host aboard every trip. We sell two kinds of service:

  • Small-group tours — priced per person, on a set route with fixed departure times. Other guests share the boat with you.
  • Private charters and transfers — priced per boat regardless of how many of you there are, up to the 12-guest limit.

Routes, timings and stops described on the site are our normal plan, not a guarantee. The skipper may change the order of stops, substitute a bay, or shorten time ashore where sea conditions, traffic or safety require it.

3.Booking and payment

Bookings made online are confirmed once payment of the deposit succeeds. We charge a 40% deposit at the time of booking; the remaining balance is paid to the crew on the day of the tour. All prices are in euro (EUR).

Card payments are processed by Viva.com, a licensed payment institution. We never see or store your full card number — it is handled entirely by the payment provider.

You are responsible for giving us a working email address and mobile number. Your confirmation and any weather notice are sent to those, so a mistyped address can mean you miss a cancellation message.

We ask that you book at least 5 hours before departure so we can confirm crew and capacity.

4.What the price includes

Unless the tour page states otherwise, the price includes the boat, fuel, a licensed skipper and host, snorkelling masks, and welcome refreshments aboard. VAT is included where the tour page says so.

Not included: food and drinks ashore, entry tickets to attractions charged separately (for example the Blue Cave on Biševo), and gratuities, which are always voluntary.

5.If you cancel or do not show up

Tell us as early as you can — by phone, WhatsApp or email. What happens next depends on timing:

  • More than 48 hours before departure: full refund of the deposit, or we move your booking to another date at no charge.
  • Between 48 and 24 hours before departure: we will move your booking to another available date; the deposit is not refunded if you simply cancel.
  • Less than 24 hours before departure, or if you do not arrive at the meeting point: the deposit is not refunded, because the seats or the boat can no longer be resold.

If you arrive late, we will wait where we safely can, but a small-group tour cannot delay departure for one party. A missed departure caused by late arrival is treated as a no-show.

Reducing your group size after booking does not reduce the price of a private charter, which is priced per boat.

6.If we cancel — weather and safety

We cancel rather than run a trip that is unsafe or genuinely unpleasant. The decision rests with the skipper and is final, and it can be made at short notice — the sea can be rough offshore on a morning that looks calm in the harbour.

If we cancel before departure, you choose between an alternative date and a full refund of everything you have paid, including the deposit.

If a trip is cut short after departure for safety reasons, we refund a fair proportion of the price based on how much of the itinerary was completed. If the trip was substantially delivered, no refund is due.

Exposed open-sea routes — above all the Blue Cave on Biševo — are cancelled far more often than sheltered inshore trips. If one of those is the reason for your visit, leave a spare day in your plans. Entry to the Blue Cave is controlled by a third party and can close independently of us; we cannot guarantee entry.

We are not liable for costs you incur elsewhere because a trip was cancelled — flights, accommodation or other bookings. Travel insurance covers that; we do not.

7.Your right of withdrawal

Under EU consumer law, the usual 14-day right to withdraw from a distance contract does not apply to leisure services supplied on a specific date or for a specific period. Boat tours and transfers fall into that category, so booking one does not give you a 14-day cooling-off period.

This does not affect your rights if we fail to provide the service, or the cancellation terms set out above, which we apply regardless.

8.Safety, conduct and who can travel

The skipper is responsible for the boat and everyone on it. You must follow crew instructions at all times, including where to sit, when to move about and when swimming is permitted.

  • Life jackets are aboard for every guest, including child sizes on request. Children must be supervised by an accompanying adult at all times.
  • Swimming is only allowed when the skipper says so, and never while the engine is running.
  • We may refuse boarding, or end a trip early without refund, if a guest is intoxicated, behaves dangerously, or puts others at risk.
  • Tell us before booking if anyone in your group is pregnant, has a heart or back condition, limited mobility, or cannot swim, so we can advise honestly whether the trip suits them.

You are responsible for your own belongings aboard. Bring dry bags for anything valuable — a speedboat is a wet environment and we cannot accept liability for water damage to phones, cameras or similar items.

9.Insurance and liability

Our boats carry the passenger liability insurance required for licensed commercial operation in Croatian waters, and we operate with the certification required to carry passengers.

We are liable for damage caused by our own failure to take reasonable care. We are not liable for events outside our reasonable control, including weather, sea state, port or authority decisions, third-party attraction closures, or your own failure to follow crew instructions.

Nothing in these terms limits liability for death or personal injury caused by our negligence, or any other liability that cannot be limited under Croatian law.

We strongly recommend travel insurance that covers cancellation, medical treatment and water activities. We do not provide it.

10.Complaints and disputes

If something goes wrong, tell the crew at the time if you can — most things are fixable on the spot. Otherwise write to info@sea-explore.com and we will reply in writing. Under Croatian consumer law we are required to respond to a written complaint within 15 days.

If we cannot resolve it between us, you may use the European Commission's online dispute resolution platform, or refer the matter to the competent consumer protection body in Croatia.

These terms are governed by Croatian law, and the courts of Croatia have jurisdiction. If you are a consumer resident in another EU country, this does not deprive you of the protection of the mandatory consumer rules of your own country.

11.Changes to these terms

We may update these terms — for example when prices, routes or payment arrangements change. The version that applies to your booking is the one published when you booked, and we will not change it retroactively to your disadvantage.
